Defendant was charged when he tried to elude the police in Fairfax (Va.).  In this case the Defendant stated as to what resulted in his act to elude the troopers.  The trial court convicted defendant as charged and sentenced him to three years in prison, suspended. Defendant filed a petition for appeal. The Circuit Court of Appeals of Virginia denied the petition. The supreme court awarded defendant a limited appeal.

What Is A Misdemeanor To Elude In VA Lawyer Code 18.2-479

Holdings:

The Virginia Court made the following holding:
  • Va. Code Ann. § 18.2-479(A) defines as a Class 1 misdemeanor escape while on a charge or conviction of a misdemeanor.
  • The improper modification of an assignment of error, however, will not prevent the appellant from arguing and having his appeal considered on the issue actually asserted in the trial court and for which an appeal was granted, provided that he has adequately briefed that issue.
  • An individual is in “custody,” as contemplated by Va. Code Ann. § 18.2-479, when a law enforcement officer has lawfully curtailed the individual’s freedom of movement to a degree associated with a formal arrest, even when a formal custodial arrest has not been effected. Applying an objective standard, the inquiry is whether the officer, with proper authority to do so, had by his words or use of physical force, curtailed the individual’s freedom of movement beyond that required for a temporary investigative detention.

Holder v. Commonwealth

Facts:

Officers were dispatched to defendant’s home in response to a complaint involving what turned out to be, after interviewing several people, misdemeanor family assault charges against defendant. An officer told defendant he was under arrest for the misdemeanor assaults. The officers then attempted to open the door to defendant’s home. Defendant resisted by trying to keep the door shut. In the process, defendant struck an officer, the door was opened, and defendant was arrested without a warrant for the misdemeanor assaults as well as the charges in this indictment, two counts of assault and battery of a law enforcement officer in violation of Va. Code Ann. § 18.2-57(c).  The defendant moved to suppress his arrest.  The issue was whether defendant was lawfully arrested, and, if not, whether his resistance to arrest was unreasonable.

Davis v. Commonwealth

Facts:

Defendant was charged with a felony involving the distribution of marijuana in Fairfax. After the jury found defendant guilty of the felony, the trial court set aside the felony verdict because the prosecutor had failed to prove the weight of the marijuana involved. On retrial for the lesser-included misdemeanor offense of distributing marijuana, the trial court denied defendant’s request to dismiss the charge on double jeopardy grounds. On appeal, defendant argued that double jeopardy applied and that the trial court erred when it refused to dismiss the charge. The court rejected defendant’s argument. The court found that defendant was not acquitted of the lesser-included misdemeanor for double jeopardy purposes by the trial court’s ruling. The court further noted that the jury’s verdict on the felony charge established that sufficient evidence had been presented at trial to sustain a verdict for the misdemeanor charge of distribution of marijuana. The court pointed out that had the trial court denied defendant’s motion to set aside the felony verdict, and defendant had appealed that decision to the court, the result would have been identical to the trial court’s disposition of this case.

  • The consistent practice in Virginia, when the evidence is found insufficient to sustain a felony conviction on appeal, but sufficient to sustain a conviction on a lesser-included misdemeanor offense, is to remand the case for retrial on the lesser-included offense. This practice is consistent with case law from other jurisdictions that holds that a post-trial finding of insufficient evidence to support a conviction requires an acquittal only as to the greater charge for which the evidence was insufficient, but does not require acquittal of a lesser-included offense adequately supported by the evidence.

Jackson v. Commonwealth

Facts:

When defendant attempted to sell drugs to a minor, the police secured the permission of her parents to involve the minor in the investigation. Defendant was arrested and charged with distributing cocaine to a minor when he attempted to carry out a drug transaction with the minor.  Defendant appealed his conviction.  On appeal, the court affirmed the conviction that was entered by the trial court. The court held that, when the evidence was viewed in the light most favorable to the theory of entrapment, it was still clear that defendant initiated the drug transaction with the minor and that the police merely afforded an opportunity for him to commit the offense. The court further rejected defendant’s contention that the Commonwealth had to prove he knew the girl was a minor.

  • The mere fact that a defendant testifies that an undercover operative first brought up the subject of drugs does not entitle him to an instruction on entrapment.
  • The phrase, “knowingly or intentionally,” in Va. Code Ann. § 18.2-255, modifies the phrase, “distribute any drug..” The Commonwealth is required to prove that a defendant knowingly or intentionally distributed a controlled drug. The statute does not require proof that a defendant knew the age of his drug purchaser.

  • To prove assault under either the criminal definition of assault or the assimilated tort definition, a sufficient causal nexus must exist among the elements of the offense–under the criminal definition, the perpetrator must commit the overt act with the intent to inflict bodily harm and have the present ability to inflict that harm; under the tort definition, the perpetrator must commit the overt act with the intent to place the victim in fear of bodily harm and the overt act must create reasonable fear in the victim.

  • Va. Code Ann. § 18.2-57.2 provides that any person who commits an assault and battery against a family or household member is guilty of a criminal offense as prescribed therein. It incorporates by reference the definition of “family or household member” contained in Va. Code Ann. § 16.1-228, which provides that “family or household member” means (v) any individual who has a child in common with the person, whether or not the person and that individual have been married or have resided together at any time; or (vi) any individual who cohabits or who, within the previous 12 months, cohabited with the person.
