Moors v. Commonwealth

Facts:

Defendant sought review of a judgment from the Circuit Court for Fairfax (Virginia), which convicted defendant of burglary with intent to commit a felony and of assault and battery.  In finding the evidence sufficient to prove that defendant committed the crimes, the court held that the jury was entitled to reject the alibi testimony because determining the credibility of witnesses who gave conflicting accounts was within the jury’s exclusive province.  The court also held that defendant was not entitled to an instruction on breaking and entering with the intent to commit a misdemeanor even though defendant was convicted of misdemeanor assault and battery. In so holding, the court noted that defendant entered the apartment with the intent to commit rape, a felony, rather than with the intent to commit a misdemeanor assault and battery.

An appellate court must discard all evidence of the accused that conflicts with that of the Commonwealth and regard as true all credible evidence favorable to the Commonwealth and all fair inferences reasonably deducible therefrom. A trial court’s judgment approving a jury verdict will not be disturbed on appeal unless contrary to the law or plainly wrong.

Penalty For Grand Larceny In Virginia Violation Code 18.2-95 Destruction Property Fairfax Richmond Beach Loudoun Prince William

The Virginia Court made the following holding:
  • Grand larceny consists of the theft, not from the person of another, of goods and chattels valued at $200.00 or more. Va. Code Ann. § 18.2-95(ii). In a prosecution for larceny, proof that an article has some value is sufficient to warrant a conviction of petit larceny, but where the value of the thing stolen determines the grade of the offense, the value must be alleged and the Commonwealth must prove the value to be the statutory amount. Thus, as grand larceny requires the theft of goods and chattels valued at $200 or more, the burden was on the Commonwealth at trial to prove that the items Watson stole met or exceeded that amount.
  • When a statute prescribes a maximum imprisonment penalty and the sentence does not exceed that maximum, the sentence will not be overturned as being an abuse of discretion. Likewise, a revocation of a suspended sentence lies in the discretion of the trial court and this discretion is quite broad.

James Wilson v. Commonwealth

Facts:

Defendant was arrested and charged with the felony offense of assault and battery on a law enforcement officer Fairfax Virginia.  The trial court found that the defendant’s arrest was improper and/or unlawful and the court defined that his resistance to that arrest did not constitute the specific crime of assault and battery of a law enforcement officer.  However, the defendant punched the officer in the face and that conduct constituted simple assault.  The trial Court found that the defendant guilty of the lesser offense of simple assault.

Scarton v. Commonwealth

Facts:

Defendant was charged with misdemeanor possession of marijuana, in violation of Va. Code Ann. § 18.2-250.1, and felony delivery of marijuana to a prisoner, in violation of Va. Code Ann. § 18.2-474.1, and he filed a motion to dismiss the charge, arguing that prosecution would violate his rights against double jeopardy.  Defendant contends that his conviction of the offense for possession of marijuana is a lesser-included offense of his second conviction for delivering marijuana to a prisoner.  The Circuit Court of Loudoun (Virginia) denied the motion, held a bench trial, and convicted defendant of the offense.  Defendant appealed.

  • Possession of marijuana is not a lesser-included offense of delivering marijuana to a prisoner, in violation of Va. Code Ann. § 18.2-474.1.
  • Where the same act or transaction constitutes a violation of two distinct statutory provisions, the test to be applied to determine whether there are two offenses or only one, is whether each provision requires proof of a fact which the other does not. A single act may be an offense against two statutes, and if each statute requires proof of an additional fact which the other does not, an acquittal or conviction under either statute does not exempt the defendant from prosecution and punishment under the other.
