Va. Code Ann § 18.2-152.3

§ 18.2-152.3. Computer fraud; penalty.

Any person who uses a computer or computer network, without authority and:

  1. Obtains property or services by false pretenses;
  2. Embezzles or commits larceny; or
  3. Converts the property of another;

is guilty of the crime of computer fraud.

If the value of the property or services obtained is $200 or more, the crime of computer fraud shall be punishable as a Class 5 felony. Where the value of the property or services obtained is less than $200, the crime of computer fraud shall be punishable as a Class 1 misdemeanor.

Penalty For Grand Larceny In Virginia Violation Code 18.2-95 Destruction Property Fairfax Richmond Beach Loudoun Prince William

The Virginia Court made the following holding:
  • Grand larceny consists of the theft, not from the person of another, of goods and chattels valued at $200.00 or more. Va. Code Ann. § 18.2-95(ii). In a prosecution for larceny, proof that an article has some value is sufficient to warrant a conviction of petit larceny, but where the value of the thing stolen determines the grade of the offense, the value must be alleged and the Commonwealth must prove the value to be the statutory amount. Thus, as grand larceny requires the theft of goods and chattels valued at $200 or more, the burden was on the Commonwealth at trial to prove that the items Watson stole met or exceeded that amount.
  • When a statute prescribes a maximum imprisonment penalty and the sentence does not exceed that maximum, the sentence will not be overturned as being an abuse of discretion. Likewise, a revocation of a suspended sentence lies in the discretion of the trial court and this discretion is quite broad.

VIRGINIA LAWYERS – CONCEAL MERCHANDISE/ALTERING PRICE TAGS STATUTE

Va. Code Ann. § 18.2-103

§ 18.2-103. Concealing or taking possession of merchandise; altering price tags; transferring goods from one container to another; counseling, etc., another in performance of such acts

Whoever, without authority, with the intention of converting goods or merchandise to his own or another’s use without having paid the full purchase price thereof, or of defrauding the owner of the value of the goods or merchandise, (i) willfully conceals or takes possession of the goods or merchandise of any store or other mercantile establishment, or (ii) alters the price tag or other price marking on such goods or merchandise, or transfers the goods from one container to another, or (iii) counsels, assists, aids or abets another in the performance of any of the above acts, when the value of the goods or merchandise involved in the offense is less than $ 200, shall be guilty of petit larceny and, when the value of the goods or merchandise involved in the offense is $ 200 or more, shall be guilty of grand larceny. The willful concealment of goods or merchandise of any store or other mercantile establishment, while still on the premises thereof, shall be prima facie evidence of an intent to convert and defraud the owner thereof out of the value of the goods or merchandise.

Penalties

  Va. Code Ann. § 18.2-103 Whoever, without authority,

  1. With the intention of converting goods or
  2.  Merchandise to his own or another’s use without having paid the full purchase price thereof, or
  3. Of defrauding the owner of the value of the goods or merchandise,
  4. Willfully conceals or takes possession of the goods or merchandise of any store or other mercantile establishment, or
  5. Alters the price tag or other price marking on such goods or merchandise, or transfers the goods from one container to another, or
  6. Counsels, assists, aids or abets another in the performance of any of the above acts
