Holder v. Commonwealth

Facts:

Officers were dispatched to defendant’s home in response to a complaint involving what turned out to be, after interviewing several people, misdemeanor family assault charges against defendant. An officer told defendant he was under arrest for the misdemeanor assaults. The officers then attempted to open the door to defendant’s home. Defendant resisted by trying to keep the door shut. In the process, defendant struck an officer, the door was opened, and defendant was arrested without a warrant for the misdemeanor assaults as well as the charges in this indictment, two counts of assault and battery of a law enforcement officer in violation of Va. Code Ann. § 18.2-57(c).  The defendant moved to suppress his arrest.  The issue was whether defendant was lawfully arrested, and, if not, whether his resistance to arrest was unreasonable.

  • Va. Code Ann. § 18.2-57.2 provides that any person who commits an assault and battery against a family or household member is guilty of a criminal offense as prescribed therein. It incorporates by reference the definition of “family or household member” contained in Va. Code Ann. § 16.1-228, which provides that “family or household member” means (v) any individual who has a child in common with the person, whether or not the person and that individual have been married or have resided together at any time; or (vi) any individual who cohabits or who, within the previous 12 months, cohabited with the person.

Peterson v. Commonwealth

Facts:

Defendant and two sub-tenants, a woman and her nine-year-old daughter, lived in the house that defendant burned.  At the time of the fire, the woman and her daughter had gone out to rent a movie.  After starting the fire, defendant also left. Defendant argued that he was guilty of a Class 3 felony, rather than a Class 2 felony, because the dwelling was unoccupied when he set fire to it.  The trial court considered defendant’s plea at his sentencing hearing and rejected it.  Defendant challenged his conviction for arson of an occupied dwelling, a Class 2 felony, under Va. Code Ann. § 18.2-77 entered by the Circuit Court of Fairfax (Virginia).

  • Burning a building that is not usually occupied by persons lodging therein at night, is a Class 3 felony, if it is done at a time when any person is therein, but only a Class 4 felony if it is done when no person is in such building. Va. Code Ann. § 18.2-79. Similarly, burning any other building or structure at a time when no person is in such building is a Class 4 felony, instead of a Class 3 felony, if otherwise. Va. Code Ann. § 18.2-80. The phrase “temporarily unoccupied” that is used in Va. Code Ann. § 18.2-77 has a different meaning.

Facts:

Defendants hosted a party for their 16-year-old child at which alcoholic beverages were served.  A police officer responded to a call reporting underage drinking and observed, after driving up the residence driveway, young people in the backyard with beer bottles in their hands. When the young people saw the officer, they began to flee.  The officer then entered the backyard without a warrant and observed numerous empty alcohol bottles.  Defendants contended that the warrantless search violated the Fourth Amendment and that the penalties were illegally imposed.  The trial court and court of appeals disagreed.

  • The Fourth Amendment protects the curtilage of a house and the extent of the curtilage is determined by factors that bear upon whether an individual reasonably may expect that the area in question should be treated as the home itself. When government agents conduct a search or seizure within protected areas of a dwelling without a warrant such actions are presumptively unreasonable and unlawful unless they are supported by both probable cause and exigent circumstances.

The Virginia Court made the following holding:
  • Va. Code Ann. § 18.2-57(C) does not require proof that the accused intentionally selected the victim as does a violation of Va. Code Ann. § 18.2-57(A), (B). A person violates § 18.2-57(C) if he commits an assault or an assault and battery against another person, knowing or having reason to know that the other person is a law enforcement officer engaged in the performance of his public duties. Nothing in the language of § 18.2-57(C) indicates a desire by the legislature to mitigate the offense if an officer is accidentally assaulted by the accused striking out in general.
  • Under Va. Code Ann. § 18.2-57(B), punishment for assault and battery is enhanced if a person intentionally selects the person against whom an assault and battery resulting in bodily injury is committed because of his race.

Facts:

Defendant appealed a decision of the Circuit Court for Fairfax (Virginia), which sentenced him under Va. Code Ann. § 19.2-306 to the balance of the maximum penitentiary sentence under Va. Code Ann. § 18.2-10(f) after defendant had been convicted of unauthorized use of a motor vehicle valued at more than $ 100, had been twice sentenced to a total of 16 months of jail time and probation, and had twice violated his probation. Johnson v. Commonwealth

Facts:

Defendant pled guilty to shoplifting of merchandise valued at less than $ 200, a third or subsequent offense.  The Circuit Court of Fairfax (Virginia) sentenced him to six years in prison, with four years and four months suspended, to be served consecutively to a sentence that he was already serving. Defendant appealed.  He argues that he did not knowingly and voluntarily plead guilty. He also argues the trial court erred in sentencing him to six years in prison (with four years and five months suspended) when the maximum penalty for the offense, a Class 6 felony, was five years. Finally, he argues the trial court abused its discretion in refusing to run any part of his sentence concurrently with the twenty-four months he was already serving on unrelated charges.

  • The main purpose underlying Va. Sup. Ct. R. 5A:18 is to alert the trial judge to possible error so that the judge may consider the issue intelligently and take any corrective actions necessary to avoid unnecessary appeals, reversals and mistrials. Rule 5A:18 applies to bar even constitutional claims. An appellate court will not consider on appeal a question not properly presented to the trial court unless the record affirmatively shows that a miscarriage of justice has occurred.
  • The maximum punishment for shoplifting, third or subsequent offense, is five years. Va. Code Ann. §§ 18.2-10 and 18.2-104.

Holdings:

The Virginia Court made the following holding:
  • Va. Code Ann. § 18.2-57.2 punishes as a Class 6 felony any act of simple assault or assault and battery against a family or household member where it is proved the defendant had two or more prior convictions for assault and battery of a family member within a period of 20 years. The statute does not alter the common law definition of assault and battery.
  • A common law assault occurs when an assailant engages in an overt act intended to inflict bodily harm and has the present ability to inflict such harm or engages in an overt act intended to place the victim in fear or apprehension of bodily harm and creates such reasonable fear or apprehension in the victim. Assault and battery is the least touching of another, willfully or in anger. A defendant does not have to intend to do harm; a battery may also be done in a spirit of rudeness or insult. The touching need not result in injury. A touching is not unlawful if the person consents or if the touching is justified or excused. An intentional touching which was not justified or excused is a battery.
