Williams v. Commonwealth

Facts:

Defendant sought review of a judgment of the Circuit Court of Fairfax (Virginia), which convicted him of possession of LSD.  The Court held that the exigency of the situation presented by a roadside stop of the vehicle in which defendant was traveling justified the immediate search of him after probable cause arose without the officers being required to obtain another warrant. The trial judge did not err by denying defendant’s motion to suppress the LSD.  The court affirmed the trial court’s conviction of defendant..

Holdings:

The Virginia Court made the following holding:
  • A trial court’s refusal to suppress evidence seized in a warrantless search will not be disturbed on appeal unless the holding is plainly wrong or without evidence to support it. When the Commonwealth bases its authority to conduct a warrantless search upon a claim that the defendant consented, the Commonwealth has the burden at trial to prove by a preponderance of the evidence that the consent was voluntary.
  • Probable cause is a flexible, common-sense standard, which merely requires that the facts available to the officer would warrant a man of reasonable caution in the belief that certain items may be useful as evidence of a crime.

Holdings:

The Virginia Court made the following holding:
  • If testimony is received that possession of an amount of drugs is inconsistent with individual personal use, it is not necessarily an opinion that the defendant intended to distribute it. A given quantity of a controlled substance can be possessed jointly by several individuals. In such a case, that amount might be inconsistent with an individual’s personal use, and yet not establish an intent to distribute.

Claret v. Commonwealth

Facts:

Defendant was convicted of assault, a violation of Va. Code Ann. § 18.2-57. The Court of Appeals of Virginia affirmed the trial court’s judgment. Defendant appealed.  Defendant’s son caused a problem on a school bus. As a result, the victim, a bus driver, had him suspended from the bus. The next day, at two separate times, defendant approached the victim’s bus and threatened him. Defendant contended that her words were insufficient to constitute assault, within the definition for assault, and there was no real physical action..

Virginia Code Assault Definition Lawyers Violation 18.2-57 Fairfax Richmond Beach Loudoun Prince William

Virginia Code Assault Definition Lawyers Violation 18.2-57 Fairfax Richmond Beach Loudoun Prince William

Holdings:

The Virginia Court made the following holding:
  • The penalty for assault is set forth in Va. Code Ann. § 18.2-57, but because the elements of assault are not statutorily defined, courts must apply the common law definition. At common law, assault is both a crime and a tort. Specifically, the common law crime of assault requires an attempt or offer committed with an intent to inflict bodily harm coupled with the present ability to inflict such harm. The common law tort of assault is completed if the tortfeasor engages in actions intended to place the victim in fear of bodily harm and creates a well-founded fear in the victim. Like many jurisdictions, Virginia merges the common law crime with the common law tort of assault. Combining the criminal and tort elements, a common law assault occurs when an assailant engages in an overt act intended to inflict bodily harm and has the present ability to inflict such harm or engages in an overt act intended to place the victim in fear or apprehension of bodily harm and creates such reasonable fear or apprehension in the victim. Regarding the common law crime of assault, courts hold that because assault requires an overt act, words alone are never sufficient to constitute an assault..

The Virginia Court made the following holding:
  • The identity of names presumption is a presumption in the sense that it is a permissible inference. A fact finder is not required to draw the inference. Whether to draw the inference, and if drawn, the strength to accord it will vary according to the particular circumstances of the case.
  • In ruling on the sufficiency of the evidence, the relevant question is whether, after viewing the evidence in the light most favorable to the prosecution, any rational trier of fact could have found the essential elements of the crime beyond a reasonable doubt.

Moors v. Commonwealth

Facts:

Defendant sought review of a judgment from the Circuit Court for Fairfax (Virginia), which convicted defendant of burglary with intent to commit a felony and of assault and battery.  In finding the evidence sufficient to prove that defendant committed the crimes, the court held that the jury was entitled to reject the alibi testimony because determining the credibility of witnesses who gave conflicting accounts was within the jury’s exclusive province.  The court also held that defendant was not entitled to an instruction on breaking and entering with the intent to commit a misdemeanor even though defendant was convicted of misdemeanor assault and battery. In so holding, the court noted that defendant entered the apartment with the intent to commit rape, a felony, rather than with the intent to commit a misdemeanor assault and battery.

Holdings:

The Virginia Court made the following holding:
  • When sufficiency of the evidence is challenged on appeal, the court must consider the evidence in a light most favorable to the Commonwealth. An appellate court must discard all evidence of the accused that conflicts with that of the Commonwealth and regard as true all credible evidence favorable to the Commonwealth and all fair inferences reasonably deducible therefrom. A trial court’s judgment approving a jury verdict will not be disturbed on appeal unless contrary to the law or plainly wrong.

Jackson v. Commonwealth

Facts:

Appellant worked out of town on an intermittent basis and stayed with the victim off and on when he came into town. He contended a finding he cohabited with the victim sufficient to sustain his conviction for domestic assault and battery was precluded. The court held the essential elements of cohabitation were sufficiently demonstrated.

Holdings:

The Virginia Court made the following holding:
  • Other factors appropriate for consideration when defining cohabitation include the length and continuity of the relationship. Although a person may have only one legal domicile at one time, he may have more than one residence for purposes of a statute proscribing domestic assault.
  • Domestic violence arises out of the nature of the relationship itself, rather than the exact living circumstances of the victim and perpetrator.

Holder v. Commonwealth

Facts:

Officers were dispatched to defendant’s home in response to a complaint involving what turned out to be, after interviewing several people, misdemeanor family assault charges against defendant. An officer told defendant he was under arrest for the misdemeanor assaults. The officers then attempted to open the door to defendant’s home. Defendant resisted by trying to keep the door shut. In the process, defendant struck an officer, the door was opened, and defendant was arrested without a warrant for the misdemeanor assaults as well as the charges in this indictment, two counts of assault and battery of a law enforcement officer in violation of Va. Code Ann. § 18.2-57(c).  The defendant moved to suppress his arrest.  The issue was whether defendant was lawfully arrested, and, if not, whether his resistance to arrest was unreasonable.

What Is Virginia Code 18.2-57 And The Punishment Lawyers Assaulting Officer

Holdings:

The Virginia Court made the following holding:
  • Va. Code Ann. § 18.2-57(C) does not require proof that the accused intentionally selected the victim as does a violation of Va. Code Ann. § 18.2-57(A), (B). A person violates § 18.2-57(C) if he commits an assault or an assault and battery against another person, knowing or having reason to know that the other person is a law enforcement officer engaged in the performance of his public duties. Nothing in the language of § 18.2-57(C) indicates a desire by the legislature to mitigate the offense if an officer is accidentally assaulted by the accused striking out in general.
  • Under Va. Code Ann. § 18.2-57(B), punishment for assault and battery is enhanced if a person intentionally selects the person against whom an assault and battery resulting in bodily injury is committed because of his race.
