James Wilson v. Commonwealth

Facts:

Defendant was arrested and charged with the felony offense of assault and battery on a law enforcement officer Fairfax Virginia.  The trial court found that the defendant’s arrest was improper and/or unlawful and the court defined that his resistance to that arrest did not constitute the specific crime of assault and battery of a law enforcement officer.  However, the defendant punched the officer in the face and that conduct constituted simple assault.  The trial Court found that the defendant guilty of the lesser offense of simple assault.

Holdings:

The Virginia Court made the following holding:
  • Va. Code Ann. § 18.2-371.1(B)(1) does not require a showing of actual injury or death. Rather, it proscribes conduct that is so “gross, wanton and culpable” as to demonstrate a “reckless disregard” for the child’s life. Such reckless disregard can be shown by conduct that subjects a child to a substantial risk of serious injury, as well as to a risk of death, because exposure to either type of risk can endanger the child’s life.

Facts:

Defendant was charged when he tried to elude the police in Fairfax (Va.).  In this case the Defendant stated as to what resulted in his act to elude the troopers.  The trial court convicted defendant as charged and sentenced him to three years in prison, suspended. Defendant filed a petition for appeal. The Circuit Court of Appeals of Virginia denied the petition. The supreme court awarded defendant a limited appeal.

What Is A Misdemeanor To Elude In VA Lawyer Code 18.2-479

The Virginia Court made the following holding:
  • Va. Code Ann. § 18.2-479(A) defines as a Class 1 misdemeanor escape while on a charge or conviction of a misdemeanor.
  • The improper modification of an assignment of error, however, will not prevent the appellant from arguing and having his appeal considered on the issue actually asserted in the trial court and for which an appeal was granted, provided that he has adequately briefed that issue.
  • An individual is in “custody,” as contemplated by Va. Code Ann. § 18.2-479, when a law enforcement officer has lawfully curtailed the individual’s freedom of movement to a degree associated with a formal arrest, even when a formal custodial arrest has not been effected. Applying an objective standard, the inquiry is whether the officer, with proper authority to do so, had by his words or use of physical force, curtailed the individual’s freedom of movement beyond that required for a temporary investigative detention.

The Virginia Court made the following holding:
  • In order to convict a defendant of “possession” of a narcotic drug, within the meaning of Virginia’s Uniform Narcotic Drug Act, it generally is necessary to show that the defendant was aware of the presence and character of the particular substance and was intentionally and consciously in possession of it. Physical possession giving the defendant immediate and exclusive control is sufficient. However, the possession need not always be exclusive. The defendant may share it with one or more. The duration of the possession is immaterial and need not always be actual possession. The defendant may be shown to have had constructive possession by establishing that the drugs involved were subject to his dominion or control. While knowledge is an essential ingredient in the crime of possession of narcotics, such knowledge may be proved by evidence of acts, declarations or conduct of the accused from which the inference may be fairly drawn that he knew of the existence of narcotics at the place where they were found.

Davis v. Commonwealth

Facts:

Defendant was charged with a felony involving the distribution of marijuana in Fairfax. After the jury found defendant guilty of the felony, the trial court set aside the felony verdict because the prosecutor had failed to prove the weight of the marijuana involved. On retrial for the lesser-included misdemeanor offense of distributing marijuana, the trial court denied defendant’s request to dismiss the charge on double jeopardy grounds. On appeal, defendant argued that double jeopardy applied and that the trial court erred when it refused to dismiss the charge. The court rejected defendant’s argument. The court found that defendant was not acquitted of the lesser-included misdemeanor for double jeopardy purposes by the trial court’s ruling. The court further noted that the jury’s verdict on the felony charge established that sufficient evidence had been presented at trial to sustain a verdict for the misdemeanor charge of distribution of marijuana. The court pointed out that had the trial court denied defendant’s motion to set aside the felony verdict, and defendant had appealed that decision to the court, the result would have been identical to the trial court’s disposition of this case.

  • The consistent practice in Virginia, when the evidence is found insufficient to sustain a felony conviction on appeal, but sufficient to sustain a conviction on a lesser-included misdemeanor offense, is to remand the case for retrial on the lesser-included offense. This practice is consistent with case law from other jurisdictions that holds that a post-trial finding of insufficient evidence to support a conviction requires an acquittal only as to the greater charge for which the evidence was insufficient, but does not require acquittal of a lesser-included offense adequately supported by the evidence.
