Appellant appeals his felony conviction for assault and battery of a family member, third offense, under Code § 18.2-57.2(B).  Appellant argues that the trial court erred when it admitted three certified criminal warrants from the Fairfax Juvenile and Domestic Relations District Court (JDR court) for the purpose of proving appellant’s predicate misdemeanor convictions for assault and battery of a family member.

  • Generally, a judgment in a criminal case may not be attacked collaterally. In a subsequent proceeding, the Commonwealth is entitled to a presumption of regularity which attends the prior conviction because every act of a court of competent jurisdiction shall be presumed to have been rightly done, till the contrary appears.
